Lewis and Clark and the Indian Country Panel Discussion Sunday

Southern Illinois University Edwardsville?s Lovejoy Library will host a panel discussion at 3 p.m. Sunday, Feb. 26 in support of the American Library Association?s (ALA) traveling exhibition: ?Lewis and Clark and the Indian Country.?

The event begins the final week of the exhibit, which concludes its run at Lovejoy Library on Mar. 2. Participating in the panel will be:

? Brad Winn, director of the Lewis and Clark Historic Site; ?Lewis and Clark Meet the Neighbors: Diplomacy, American Indians and the Lewis and Clark Expedition.?

? Gregory Fields, SIUE professor of philosophy; ?Coast Salish Cowlitz Cultural Revitalization.?

? Rowena McClinton, SIUE professor of historical studies; ?The Corps’ Encounters During the 1804 Winter with Mandans and Hidatsa.?

? Robert Paulett, SIUE assistant professor of historical studies; ?Orienting the Explorers: Lewis and Clark?s Cartographic Context.?

The exhibit, which opened at Lovejoy Library on Jan. 18, tells the story of the explorers? historic 1804?1806 expedition from a different point of view?that of the Indians who lived along their route. During their journey to the Pacific coast and back, Meriwether Lewis and William Clark and their small group of voyagers crossed the traditional homelands of more than 50 Native American tribes. The exhibit examines this monumental encounter of cultures and examines the past and present effects of that encounter on the lives of the tribes which still live in the region.

?Lewis and Clark and the Indian Country? draws upon original documents in the rich Native American collections of the Newberry Library, and in the collections of the Washington State Historical Society, the Minnesota Historical Society and other institutions. Photographs of handwritten documents, maps, paintings and drawings provide a colorful background for the story of the encounter.

Organized by Chicago?s Newberry Library in cooperation with the ALA Public Programs Office, ?Lewis and Clark and the Indian Country? was made possible by a major grant from the National Endowment for the Humanities (NEH): great ideas brought to life. Additional support came from the University of Illinois at Urbana-Champaign. The Sara Lee Foundation is the lead corporate sponsor; Ruth C. Ruggles and the National Park Service also supported the exhibit.

Napp receives 'recommended' rating in ISBA poll

More than 90 percent of lawyers who participated in an Illinois State Bar Association (ISBA) poll in the Third Judicial Circuit believe that Madison County Associate Judge Kyle Napp meets the requirements of office.

Napp, a Democrat, is seeking election to the circuit seat currently held by Judge Charles Romani, who plans to retire when his term expires in December.

Napp is running unopposed in the primary election on March 20.

She was appointed associate judge in 2007 and presides in the court's felony division. Prior to serving as judge, she worked 14 years as an assistant Madison County state's attorney.

"I am pleased that the lawyers that practice before me are confident in my abilities as a judge and i think these numbers reflect that," Napp said in an email. "This poll is consistent with the poll taken in April of 2011, and I will continue to work hard and Be the kind of judge the people deserve."

Republicans vying for the same seat did not fare as well in the ISBA poll.

Thomas Burkart of Hamel only received a rating of 46.39 on the question of whether he meets the requirements of office. In order to receive a "recommended" rating, candidates must receive at least a 65 percent rating.

Burkart, who is experienced in civil and criminal litigation, has been the supervising attorney for Burkart Law since it opened in 1986. He also has served as a Madison County public defender.

The ISBA mailed ballots to 547 to member lawyers in the circuit and 203 lawyers responsed. Non-member, licensed lawyers within the circuit may also participate in the poll by requesting a ballot.

Mark Rabe of Edwardsville, a Republican who will face Burkart in the primary, had too few responses for a valid poll, according to the ISBA.

Rabe works as in-house counsel for Boeing in St. Louis.

A woman claims she is unable to return to her job at United States Steel Corporation after she was groped by security officers searching for an alleged hidden recording device on her body that she insists was not in existence.

Cynthia Patterson filed a lawsuit Feb. 10 in Madison County Circuit Court against United States Steel Corporation and Chad C. Weiss.

In her complaint, Patterson alleges she was working at U.S. Steel on Feb. 12, 2010, when her supervisor, Weiss, accused her of recording other employees without their knowledge or permission. Patterson contends the allegations were not true.

Because of Weiss's indictment, security officers restrained Patterson from leaving her office while they groped her and forced her to disrobe in an attempt to find the alleged hidden recording device, according to the complaint.

"Plaintiff was prevented from leaving to use the bathroom, before and after she urinated in her clothing," the suit states. "Plaintiff was told she 'was not going anywhere.'"

Because of the incident, Patterson claims she suffered embarrassment, humiliation and extreme emotional distress. She experienced a "permanent emotional break down constituting permanent disability and inability to work," the complaint says.

In her four-count complaint, Patterson seeks a judgment of more than $300,000, plus other relief the court deems just.

Pizza Hut sued over delivery driver's Highland accident

A woman claims she sustained injuries after a Pizza Hut delivery driver struck her vehicle.

Elizabeth M. Perry filed a lawsuit Feb. 13 in Madison County Circuit Court against Patrick A. Maurer and Pizza Hut.

In her complaint, Perry alleges she was driving near a stoplight at 1000 Laurel Street in Highland on Feb. 28, 2010, when Maurer, who was operating his vehicle near the same stop light, struck her vehicle.

In addition to her injuries, Perry experienced pain, incurred medical costs and lost earnings because of the collision, according to the complaint.

Perry blames Maurer, who was driving for Pizza Hut at the time of the collision, for causing the accident, saying he negligently failed to maintain a proper lookout, drove too fast, drove without adequate brakes and failed to properly apply his brakes, among other negligent actions.

In her two-count complaint, Perry is seeking a judgment of more than $100,000, plus costs.

Fifth District Appellate Court candidates Stephen McGlynn and Judy Cates both were rated "highly qualified" in an Illinois State Bar Association (ISBA) poll conducted of lawyers within the district.

The poll was conducted by mail and sent to all ISBA members in the district and to non-member licensed lawyers who may have requested a ballot.

In the McGlynn-Cates match-up, the ISBA mailed 1,883 ballots, of which 827 were returned.

For McGlynn, 70.28 percent of respondents said he met requirements of office; For Cates, 70.09 percent said she met requirements of office. Candidates must receive a score of at least 65 percent to be "recommended."

McGlynn, a Republican, is a sitting circuit judge in St. Clair County. He was appointed to the seat following the July 2010 retirement of former Circuit Judge Michael O'Malley.

McGlynn also served on the appellate court, having filled a vacancy after Gordon Maag lost a retention race in 2004. In the general election race of 2006, McGlynn lost the seat to Bruce Stewart of Harrisburg.

Cates, a Democrat, is a Swansea personal injury attorney. She had previously sought a seat on the appellate court, but lost a primary race in 2008 to James Wexstten of Mount Vernon.

On the question of integrity, McGlynn was rated 82.49 to Cates who was rated 77.06 by respondents.

However, on the question of legal ability, Cates was rated 94.21 compared to McGlynn's rating of 74.42.

"Judy Cates is well-respected for her legal knowledge and ability," states a biographical sketch of Cates that accompanied the poll results. "She has served as the president of the Illinois Trial Lawyers Association and has received numerous national and local honors."

On the question of temperament, McGlynn was rated 85.94 to Cates' rating of 66.60.

"As a judge, Judge McGlynn is known for treating persons not represented by counsel with respect, reviewing court files before hearings, and making thoughtful rulings," says McGynn's bio associated with the poll. "He is well-respected by attorneys and parties as an impartial and fair judge."

SPRINGFIELD - All candidates for Illinois judicial offices in the March 20 primary election have been rated by Illinois State Bar Association (ISBA) evaluation committees, or in a poll conducted by ISBA.

In counties outside Cook, an advisory poll is conducted by mail and sent to all ISBA members in the circuit or district from which a candidate seeks election. Licensed lawyers who are not members of ISBA may request a ballot.

"Through these polls and evaluations, voters are provided the opportunity and responsibility of selecting qualified individuals to serve as judges to assure effective administration of our system of justice," said ISBA President John G. Locallo of Chicago.

"I encourage voters to consider these poll results when deciding how to vote on March 20."

In Cook County, an ISBA Judicial Evaluations committee used the results of a questionnaire and interviews to rate candidates for all judicial offices.

Candidates for the appellate court outside Cook County were also evaluated using this process.

A man claims his employer terminated him after he filed for workers' compensation benefits.

Justin A. Nasello filed a lawsuit Feb. 15 in Madison County Circuit Court against GBC Metals doing business as Olin Brass.

In his complaint, Nasello claims he was working for Olin Brass on July 18 when he sustained injuries. Due to his injuries, Nasello filed for workers' compensation, according to the complaint.

After Nasello requested the benefits, Olin Brass fired him, the suit states.

"The defendant herein knowingly, willfully and wantonly and with a callous disregard for the rights and welfare of the plaintiff, discharged the plaintiff from its employment by way of punishment for the continued pursuit of his rights under the Illinois Workers' Compensation Act," the complaint says.

Because of his job loss, Nasello claims he lost income and benefits, suffered from mental anguish and sustained pain.

In his two-count complaint, Nasello is seeking a judgment of more than $100,000, plus costs.

Jon Rosenstengel of the Law Offices of Bonifield and Rosenstengel in Belleville will be representing him.

Aaero sues St. Louis Regional Airport over what it claims are 'deplorable' conditions

An airline has filed suit against the airport out of which it is attempting to operate, saying it is unable to use one of the two hangars to which it is assigned due to deplorable conditions.

Aaero Aviation Services claims it began offering flights from defendant St. Louis Regional Airport in 2010 after entering into a "Fix Based Operator Lease and Operating Agreement" on March 1, 2010.

According to the terms of the lease, the airport agreed to provide maintenance and repairs to the structures attached to the airport, such as the walkways leading to planes, the suit claims.

However, Aaero claims it is unable to use one of the two hangars it is leasing because of despicable conditions that the airport refuses to maintain. For instance, sliding doors will not seal, which allows outside elements and varmints to enter the hangar, and hangar door guiderails remain in an unsafe condition, according to the complaint filed Feb. 15 in Madison County Circuit Court.

Poor insulation, a leaking roof and holes in the walls of the hangar make it difficult and expensive to heat; customers cannot go to the bathroom because of faulty facilities that are inoperable; and bare wires hang exposed, the suit states.

Other conditions, such as a leaky roof and exterior windows and a roof ridge vent that refuses to close, remain problems for Aaero because St. Louis Regional Airport Authority refuses to correct them, the complaint says.

"As a direct and proximate result of the failure of the Airport to comply with the Lease and/or to maintain the leased premises in a reasonably safe and repaired condition fit for commercial use, the plaintiff has been unable to make safe and commercial use of hangar 17 for the purposes set forth in the said lease," the suit states. "As a further direct and proximate result, the plaintiff, AAS, has been required to perform its operations from Hangar 18 and has lost the use and benefit of Hangar 17."

Due to its inability to provide adequate reception facilities for passengers, Aaero claims it has lost profits.

In its complaint, Aaero is seeking a judgment of at least $50,000 and an order either that the airport has breached its lease or directing the airport to perform the requested repairs. It also is seeking attorney's fees, costs and other relief the court deems just.

It will be represented by David W. Dugan of East Alton.

ST. LOUIS - Three women are accusing a drug manufacturer of lying about the effects of an anti-depressant on pregnant women and their unborn children. The women claim their children were born with various birth defects, including spina bifida and a club foot, because of the prescription drug.

Kimberlee Fisher, Kristy Hernandez and Leah Scott filed three separate lawsuits Feb. 16 in St. Louis Circuit Court against Forest Laboratories and Forest Pharmaceuticals.

The women are represented by Steven Aroesty of Napoli, Bern, Ripka, Shkolnik and Associates in Edwardsville.

In their complaints, Fisher, Hernandez and Scott allege they ingested the anti-depressant Lexapro while they were pregnant with their children, Isabella, Kayla and Damien Guidry, respectively. When Isabella was born on Nov. 23, 2009, she was diagnosed with spina bifida, which was the result of the Lexapro, according to the complaint. Kayla had a club foot when she was born on Aug. 6, 2010 while Guidry had a bilateral cleft lip and palette upon his arrival on Dec. 28, 2007, the suit states.

Lexapro was developed by Forest. At the time Kimberlee Fisher, Kristy Hernandez and Leah Scott took the drug, Forest knew of its propensity to cause congenital birth defects, perhaps because of the increased levels of serotonin that Lexapro promotes, the suits state.

Despite its knowledge of the drug's risks to pregnant women and their children, Forest promoted Lexapro toward women of child-bearing age, including expectant mothers, the complaints say.

Kimberlee Fisher, Kristy Hernandez and Leah Scott claim they did not know of the drug's harmful effects until after their daughters were born. They would not have been aware of the risks because Forest negligently failed to fully disclose the results of tests it had conducted and failed to warn the medical community that the drug would cross the placenta into the unborn fetus, according to the complaints.

Kimberlee Fisher, Kristy Hernandez and Leah Scott allege Forest failed to warn them and others of the risks of the drug, breached its express warranty and its implied warranty by implying that the drug was safe for pregnant women when it was not and engaged in fraud by denying any connection between the anti-depressant and birth defects.

"In flagrant and conscious disregard and indifference, Forest Defendants have denied publicly that any connection between Lexapro and birth defects exists, and have failed utterly to take any measures whatsoever to alert the public, the prescribing physicians, and the patients who take it, of the incipient dangers associated with Lexapro," the suits state.

In their complaints, Kimberlee Fisher, Kristy Hernandez and Leah Scott seek general damages in excess of the minimum jurisdictional limits of St. Louis Circuit Court, plus medical costs, pre- and post-judgment interest, punitive and exemplary damages, costs and other relief the court deems just.

ST. LOUIS - An additional four asbestos cases have been added to the docket in St. Louis Circuit Court.

On Feb. 14, four new complaints were filed in the 22nd Judicial Circuit in the City of St. Louis.

Randy Cohn, Myles Epperson and Shane Hampton of the Simmons, Browder, Gianaris, Angelides and Barnerd law firm in Alton were among the attorneys that brought them.

Bert L. and Gloria Dobson sued 63 defendant corporations while Janice Kassman filed a lawsuit against 11 defendant corporations. Stella Lambert named 38 companies as defendants. Danielle Wolfe listed 38 defendant corporations in her complaint filed on behalf of her deceased mother, Barbara Kuhl. None of the plaintiffs specify where they reside.

In their complaint, the Dobsons allege the defendant companies caused Bert L. Dobson to develop mesothelioma after his exposure to asbestos-containing products throughout his career as a mechanic, laborer and farmer at various locations from 1959 until 2007.

In her complaint, Janice Kassman alleges her recently deceased mother, Phyllis Armo, developed mesothelioma after she worked as a welder at the Brooklyn Naval Shipyard from 1941 until 1945.

Robert Lambert developed mesothelioma after working as a laborer and manager at various locations throughout the United States, according to his wife's complaint.

Danielle Wolfe claims her mother, Barbara Kuhl, developed mesothelioma after her exposure to asbestos products during her career as a bookkeeper, dental assistant and waitress at various locations from 1960 until 2002.

Kuhl was also secondarily exposed to asbestos fibers through her husband, who worked as a contractor, builder, carpenter and foreman from 1977 until 1980 and through her brother-in-law, who worked as a mechanic from 1950 until 1962.

The defendants should have known of the harmful effects of asbestos, but failed to exercise reasonable care and caution for the plaintiff's safety, the suits state.

As a result of their asbestos-related diseases, Bert L. Dobson, Armo, Robert Lambert and Kuhl became disabled and disfigured, incurred medical costs and suffered great physical pain and mental anguish, the complaint says. In addition, they became prevented from pursuing their normal course of employment and, as a result, lost large sums of money that would have accrued to them, the plaintiffs claim.

Because of Armo's,Robert Lambert's and Kuhl's deaths, their family have incurred funeral costs and have been deprived of their support and society.

In their four-count complaint, the Dobsons are seeking actual and compensatory damages of more than $50,000, and punitive and exemplary damages of more than $50,000, plus other relief the court deems just.

In her four-count complaint, Kassman is seeking punitive and exemplary damages of more than $50,000 and actual and compensatory damages of more than $50,000.

An additional two asbestos cases have been added to the St. Louis Circuit Court docket.

On Feb. 16, two new complaints were filed in the 22nd Judicial Circuit in the City of St. Louis. Randy L. Gori and Barry Julian of Gori, Julian and Associates in Edwardsville brought them. Erik Karst and J. Kyle Beale of Karst and Von Oiste in Houston will serve of counsel in the Araujo case.

Patrick and Maureen Appert sued 185 defendant corporations while Carlos Araujo filed a lawsuit against 44 defendant corporations. Neither the Apperts nor Araujo specify where they reside.

In their complaint, the Apperts allege the defendant companies caused Patrick Appert to develop mesothelioma after his exposure to asbestos-containing products throughout his career as a laborer on a family farm in Hazelton, N.D., from 1957 until 1971, as a laborer at a snowmobile manufacturer in Wahpeton, N.D., from 1971 until 1972, as a welder at Missile Site in Langdon, N.D., in 1972 and at a transformer station in Kansas City, Mo., in 1973, as a welder at a railroad repair shop in Kansas City, Mo., in 1973, as a welder at a nuclear power plant in Crystal River, Flor., and at a propane tank facility in Homosassa Springs, Flor., as a welder at Welk's Metal in Mandan, N.D., from 1973 until 1974, as a welder and pipefitter at Lelands Olds Power Plant in Stanton, N.D., and at Heskett Power Station in Mandan, N.D., from 1974 until 1975, as a welder, heater installer and pipefitter at Mandan Oil Refinery in Mandan, N.D., from 1975 until 1976 and from 1982 until 1983, as a boiler worker at Minnkota Power Plant in Center, N.D., from 1976 until 1977, as a pipefitter and boiler worker at Coal Creek Power Station Underwood, N.D., from 1977 until 1979, as a pipefitter and boiler worker at Antelope Valley Power Station in Beulah, N.D., from 1980 until 1981 and in 1984, as pipefitter and boiler worker at UPA Power Station in Stanton, N.D., in 1981, as a pipefitter and welder at ANG Gas Plant in Beulah, N.D., from 1981 until 1983, as a welder and Egan and Sons Fabrication Shop in Mandan, N.D., from 1982 until 1983 and as a pipefitter at Koch Oil Refinery in Rosemont, Minn.

Patrick Appert was also secondarily exposed to asbestos fibers through his father, who was a pipefitter and plumber, and through his grandfather, who was a plumber, according to the complaint.

In his complaint, Carlos Araujo alleges his recently deceased father, Americo Araujo, developed mesothelioma after he worked as a bricklayer for various constructors from the mid-1950s through the 1980s.

The defendants should have known of the harmful effects of asbestos, but failed to exercise reasonable care and caution for the plaintiff's safety, the suits state.

As a result of their asbestos-related diseases, Patrick Appert and Americo Araujo became disabled and disfigured, incurred medical costs and suffered great physical pain and mental anguish, the complaint says. In addition, they became prevented from pursuing their normal course of employment and, as a result, lost large sums of money that would have accrued to them, the plaintiffs claim.

Because of Americo Araujo's death, his family has incurred funeral costs and has been deprived of his support and society.

In their 15-count complaint, the Apperts are seeking actual and compensatory damages of more than $400,000, economic damages of more than $150,000 and punitive and exemplary damages of more than $50,000, plus other relief the court deems just. They also seek punitive damages in an amount sufficient to punish Reichhold for its misconduct and to deter the company from similar actions in the future.

In his 11-count complaint, Carlos Araujo is seeking punitive and exemplary damages of more than $25,000, aggravated damages against each of the defendants of more than $25,000, economic damages of more than $150,000 and actual and compensatory damages of more than $200,000.
